Participant Behaviour
The tours and schools that we run are designed for the maximum enjoyment of all riders. Our tours and schools are not designed as ‘a race’ and as such we ask all participants to behave in a responsible and courteous manner to all other riders, the public and our guides. Participants that are found to be riding in an irresponsible or dangerous manner will be cautioned and if this behaviour continues the guide will call an end to the participants tour or school without refund. Any riders found to be under the influence of alcohol or drugs will be refused participation without refund.

Motorcycle Damages
We will not charge the customer for minor damage such as scuffs/scratches incurred under normal riding circumstances such as low speed falls or accidentally dropping the bike. Damages such as broken plastics, smashed headlights, bent bars etc will be charged in full at cost. If you choose to take out our optional damage cover priced at £20 per day, you will be covered for damages up to £250, any damages above this figure will become chargeable. All TrailWorld equipment must be treated with respect and participants found abusing our equipment will be politely cautioned and if this behaviour continues, asked to leave without refund. The judgement of our guide or staff member is final and by booking with us you accept this statement.

If the motorcycle or other vehicle that you have been assigned is damaged in such a way that it becomes unsafe, or inoperable due to rider error, TrailWorld Limited are not at liberty to supply a replacement vehicle and you will be recovered, along with the motorcycle or other vehicle and returned to base at your cost. All water crossings, hill climbs and other challenging terrain is undertaken at your own risk and is completely optional. If a motorcycle or other vehicle becomes inoperable due to mechanical failure, TrailWorld Limited will do everything possible to supply a replacement where possible, or to offer an alternative date to complete your tour.

Freewill - You understand that your participation in a TrailWorld Limited activity is completely optional and undertaken at your own risk.

Refunds & Cancellations - Deposits are non-refundable and only transferable at our discretion. Your commitment to TrailWorld Limited starts six weeks prior to riding with us, even if you have not paid your final balance in full. If you cancel after this date you will be invoiced for any outstanding balances - this is to protect us and allow us enough time to fill the dates that you have committed to.

4-6 weeks prior to your adventure tour/school/activity - 50% refund.
2-4 weeks prior to your adventure tour/school/activity - 25% refund.
0-2 weeks prior to your adventure tour/school/activity - no refund.

IMPORTANT - If you decide to cut short your tour, school or other activity with us for any reason or do not turn up on a particular day on a multi day tour, TrailWorld Limited are not at liberty to offer a refund or organise another day for your tour.

By paying your deposit you are agreeing to these terms.

       
1. Definitions
   
1.1 ‘the Activity’ means a guided trail riding tour, training school or other off-road based experience provided by TrailWorld Limited.
1.2 ‘TrailWorld’ and “Andalucian Trail Tours” means TrailWorld Limited trading as TrailWorld Limited.
1.3 ‘the Customer’ means the person who takes part in the activity.
1.4 ‘the Conditions’ means the terms and conditions set out in this document and any special terms and conditions agreed in writing by TrailWorld.
1.5 ‘the Contract’ means each and every contract for the provision of services between TrailWorld and the Customer.
       
2. Terms and Conditions Applicable
       
2.1 The Conditions apply to the Contract to the exclusion of all other terms and conditions.
2.2 Any variation to these Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by TrailWorld.
2.3 The Contract shall be formed at the time of acceptance by TrailWorld of a booking of an Activity by a Customer and payment of the deposit by that Customer.
2.4 All customers must hold a full and valid motorcycle licence for the type of motorbike that will be used in the Activity where required and must be able to present it upon request. (N/A Schools)
2.5 All Customers must be aged 21 or over to participate in a guided off-road motorcycle tour, or aged 16 and over for any other activity which takes part on our private land.
2.6 Each Customer shall pay to TrailWorld Limited a non-refundable deposit as stated for each activity in order to secure participation in the Activity.
2.7 The balance of the amount due will be paid by the Customer by cheque or Credit Card to TrailWorld Limited 21days prior to participating in the Activity. If payment is made on the day due to a late booking it must be settled in cash only - TrailWorld do not accept credit cards and cheques on the day of your activity due to operational restrictions. Vouchers are non-refundable.
2.8 All cheques to be made payable to “TrailWorld Limited”.
2.9 In the event that any property owned by TrailWorld is damaged or lost whilst in the customers possession, the cost of the item will be paid by the Customer. Damage to the motorcycles or other vehicles caused by negligence will be charged at cost.
2.10 TrailWorld reserves the right to change the track locations due to weather conditions and the standard of ability of the Customer and will inform the Customer of any changes prior to the commencement of the Activity. Location is also subject to change should one of our guides become unavailable due to sickness or injury - TrailWorld will endeavour to give as much notice as possible in these circumstances.
2.11 None of the provisions of the Conditions are intended to or will operate to confer any benefit on a person who is not made a party to the Contract.
       
3. Force Majeure
       
3.1 Neither party shall be liable for any default due to any act of God, war, strike, lockout, industrial action, fire, flood, drought, tempest, or other event beyond the reasonable control of either party.
       
4. Customer Disclaimer & Acknowledgement of Conditions
       
4.1 By booking with TrailWorld the Customer confirms that he has read and understands these Conditions and acknowledges that:-
4.1a He understands that the activity may be hazardous and freely agrees to voluntarily expose himself to risk of injury damage or loss
4.1b Competitive riding and racing is not permitted
4.1c TrailWorld is not a training organisation and tour guides are on hand to give guidance on the route only. Training is only available at our off-road schools.
4.1d He is responsible for the way in which he uses the motorcycle or other vehicle and rides it during the activity
4.1e He will wear a helmet and the appropriate protective clothing during the Activity
4.1f He has disclosed to TrailWorld any medical condition or medication being taken and confirms that he is physically fit and does not suffer from any medical condition which may adversely affect his ability to control a motorcycle
4.1g He will not participate in the Activity whilst under the influence of alcohol or drugs
4.1h He acknowledges that TrailWorld shall not be liable for the death of or injury to the Customer or any loss or damage to the Customers property unless due to negligence or other failure of TrailWorld to perform its obligations under this Contract or the general law. In the event of any breach of the Contract by TrailWorld the remedies of the Customer shall be limited to damages. Under no circumstances shall the liability of TrailWorld exceed the price of the Activity provided that nothing in these Conditions shall restrict or exclude liability for the death of or injury to the customer
       
5. Law and Jurisdiction
       
5.1 The Conditions and the Contract shall be governed by English Law and the Customer consents to the exclusive jurisdictions of the English Courts in all matters.
       
6.Miscellaneous
       
6.1 All headings are for ease of reference only and shall not effect the construction of the Conditions.
6.2 Any provision contained in the Conditions which is or may be void or unenforceable shall to the extent of such invalidity or unenforceability be deemed severable and shall not effect any other provisions of the Conditions.
       
PLEASE NOTE THAT IF YOU ARE PAYING A BALANCE ON THE DAY, WE MAY NOT HAVE FACILITIES TO ACCEPT CHEQUES OR CREDIT CARDS. PAYMENTS MUST BE SETTLED IN FULL ON ARRIVAL IN CASH BEFORE RIDING COMMENCES.
